01-20-10 - Bloch Lumber Caution
-
Bloch Lumber has defaulted on their financial obligations and their assets were foreclosed on by the lender. Bloch Lumber was purchased through an auction conducted by the lien holder of their financial obligations, Bloch Lumber assets were purchased by Sherwood Lumber. It appears that Sherwood Lumber only purchased the assets and name of Bloch Lumber and even though they are still using the Bloch Lumber name Sherwood Lumber is not going to honor any liabilities Bloch Lumber has to carriers that hauled loads prior to January 1, 2010. Shippers Point has closed the Bloch Lumber account in Shippers Point and are doing an investigation into any recourse carriers that have unpaid invoices with Bloch Lumber may have.
Opinion of a owner of a Trucking company "If the original company didn't go through bankrauptcy court, the company that takes control would still be legally obligated to the debts. Check with an attorney in the state of jurisdiction.. Otherwise, all companies would simply change hands to a competitor or like company and leave whatever debt was accumulated. "

04-13-09 - Broker Carrier Agreements
-
It is the opinion of Shippers Point that; If a truck broker is past due on payments for any loads you may have hauled for them, they are in violation of the terms of the Broker Carrier agreement and by their actions can cause the terms of the contract to be unenforceable. Carrier should no longer be bound by the no back solicitation clause.
